Copyright and related right matters often appear as a stumbling block, whereby a clear definition of what is allowed and what is forbidden cannot be made in the majority of cases. Web archiving is therefore in many ways in a grey area, which is marked by the absence of clear judicial decisions. Most justiciable copyright conflicts end in settlement, which, as it refers to the specific case, hardly allows generalized conclusions.

It is therefore essential for the web archivist to be up to date with current copyright discussions.
